Terms and Conditions
- Payment – The CMIxAMA PCM Content Marketing program is an investment of one thousand three hundred ninety-five dollars ($1395.00). The CMI Standard program is an investment of nine hundred ninety-five dollars ($995.00). All sessions in the course are available upon payment.
- CMI accepts the following methods of payment: Credit card, American Express, Visa, or Mastercard and will appear on your statement as UBM.
- CMI processes all fees, charges, and/or debits to credit cards or to other financial accounts in U.S. dollars within 1 day of receiving your access request
- Your financial institution or credit card company may charge fees in association to these transactions. Consult your financial institution for a list of these fees.
- Learner shall reimburse CMI for any and all insufficient funds/credit fees.
- Learners are eligible for a refund within 2 weeks of signing up for the training. No refunds will be issued after two weeks, and the learner is responsible for the full access cost Learners who have completed more than 50% of the course are not eligible for a refund. A $50 processing fee will be charged for all refunds. CMI is not responsible for any additional fees incurred during the refund process.
- If your organization has corporate access for training, these payment terms do not apply.
- General Business Information. The modules, and information set forth in the materials available to learners are provided as general business information. The materials have not been approved, licensed or accredited by any agency or organization for the purposes of conferring GEDs, diplomas, degrees or for any primary, secondary or post-secondary education purposes.
- No Breach of Access. CMI will use commercially reasonable efforts to make the materials available to learners. Learner’s inability to access on-line materials under this agreement shall not constitute a breach of this agreement if learner’s ability to access materials has been caused by:
- power or internet outages not caused by the negligence of CMI;
- storms, floods, earthquakes, tornadoes, riot, general civil unrest, other act of nature, or other causes beyond the commercially reasonable control of CMI;
- viruses, malware, worms, Trojan horses or other electronic attacks instituted by third-parties;
- incompatibility of learners hardware and/or software with the materials;
- scheduled maintenance, updating, editing, uploading, or other action taken by CMI to improve the materials provided; and/or
- criminal acts.
- Limited Liability. Learner expressly agrees that use of the materials is at learner’s sole risk. Neither CMI, UBM/Informa, its employees, agents, or contractors warrant that the materials will not be interrupted or error free; nor do they warrant or guarantee any results that may be obtained by Learner’s use of the materials/services or as to the accuracy, reliability or content of any information contained in the materials unless expressly stated in this agreement. Under no circumstances, including negligence, shall CMI, UBM/Informa, its employees, agents, contractors or anyone else involved in creating, producing or distributing the materials be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the materials; or that results from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission or any failure of performance, whether or not limited to acts of God, communication failure, theft, destruction or unauthorized access to CMI’s or UBM’s/Informa’s records, programs or services. Learner hereby acknowledges this paragraph shall apply to all content provided under this agreement. Notwithstanding the above, Learner’s exclusive remedies for all damages, losses and causes of actions whether in contract, tort including negligence or otherwise, shall not exceed the aggregate amount which Learner paid during the term of agreement.
- Use of Materials. Each individual Learner has limited, non-transferable archive access to the materials for up to 12 months. Learners shall not share, sell, give, or otherwise transfer this access to another without the prior express written consent of CMI. Please contact CMI directly if you wish to obtain a corporate access or group access. Learners shall not share, copy, alter, amend, or attempt to copy, alter or amend the materials.
- Merger. This Agreement sets forth the entire agreement of the parties with respect to the subject matter of this Agreement, and supersedes all prior negotiations, agreements and understandings with respect thereto. This Agreement may only be amended by a written document duly executed by all parties
- Choice of Law. This Agreement is made and shall be interpreted according to the laws of the State of New York. The Parties agree that sole, exclusive jurisdiction for any dispute arising out of this Agreement, or the activities contemplated by this Agreement, shall be vested in the appropriate court located within New York, NY.
- Severability. If any provision of this agreement is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this agreement shall remain in full force and effect.
- Non-waiver. The failure by one party to require performance of any provision shall not affect that party’s right to require performance at any time thereafter, nor shall a waiver of any breach or default of this agreement constitute a waiver of any subsequent breach or default or a waiver of the provision itself.
